International Terms of Service

1. General Provisions

By accessing or using the website "h-ope.work" (hereinafter referred to as the "Site"), operated by Hangover Plate Co., Ltd. (hereinafter referred to as the "Company"), you agree to be bound by these Terms of Service. 2. Payment and Pricing

  • Payment Methods: We accept major credit cards (Visa, MasterCard, American Express, JCB) and payments through various third-party payment service providers. Registration with these providers may be required.

  • Price Revisions: The Company reserves the right to modify the prices displayed on the Site at any time without prior notice.

  • Pricing Errors: While we strive to maintain accurate pricing on the Site, errors may occur. In the event of a pricing error, you will be notified via email before your order is shipped to confirm the correct price or cancel the order.

  • Shipping Fees: Shipping fees are not included in the product price. Shipping costs are determined based on the destination and weight, and will be automatically calculated by the online store's system at checkout.

3. International Shipping and Customs Duties

  • Responsibility for Duties and Taxes: Orders shipped outside of Japan may be subject to customs duties, import taxes, and other fees levied by the authorities of the destination country. These charges are NOT included in the product price or shipping fees and are the sole responsibility of the customer (the importer).

  • Customs Clearance: By placing an order with the Site, you acknowledge and agree that you are responsible for the payment of all applicable duties and taxes and for complying with all import regulations of the destination country. For more information regarding customs and taxes in your country, please contact your local customs office. The Company has no control over these charges.

4. Shipping Policy

  • Carriers: The Company typically utilizes EMS (Express Mail Service) as the primary carrier, but may use other carriers depending on the destination or specific circumstances.

  • Additional Charges: Additional fees may apply in the case of special delivery requests or specific circumstances at the destination.

  • Tracking: Following shipment, the Company will send a shipping confirmation email including a tracking number. You may check the status of your order via the carrier's website.

5. Cancellations, Returns, and Exchanges

  • Cancellations: Orders cannot be cancelled unless a written request is made and approved by the Company within 24 hours of purchase.

  • Return Policy: Due to the nature of our products, we do not accept returns, exchanges, or refunds for reasons attributable to the customer's preference (e.g., change of mind, perceived differences in color or image, or incorrect size selection).

  • Defective or Incorrect Items: In the event of a wrong delivery or a defective product, please contact us immediately upon receipt. Returns or exchanges will only be considered if the item is unused, with all tags attached, and in its original packaging. Solutions will be discussed and decided between the Company and the customer.

  • Unauthorized Returns: The Company will not accept any returns without prior written authorization.

6. Lost or Damaged Items

  • You understand and agree that the Company shall not be liable for any direct or indirect damages resulting from shipping processes (loss, damage, etc.) once the item has been dispatched. All items are purchased at the customer's own risk.

  • For any damage or loss occurring during transit, the customer shall negotiate directly with the shipping carrier. The Company will provide the tracking number and carrier contact information upon request, but the responsibility for following up with the carrier rests solely with the customer.

7. Intellectual Property (Copyright)

All content on the Site (including but not limited to images, graphics, text, and logos) is the exclusive property of Hangover Plate Co., Ltd. and its respective owners. All materials are protected by international copyright and intellectual property laws. No part of this Site may be copied, transmitted, reproduced, or modified without the express written permission of the Company.

8. Disclaimer

This Site and all its contents are provided on an "AS IS" basis without warranties of any kind, either express or implied, including but not limited to warranties of title or implied warranties of merchantability or fitness for a particular purpose.

9. Indemnification

You agree to defend, indemnify, and hold Hangover Plate Co., Ltd. harmless from and against any and all claims, damages, costs, and expenses, including attorney's fees, arising from or related to your use of the Site or breach of these Terms.

10. Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of Japan, without giving effect to any conflict of law principles.

  • Language: These Terms are provided in both Japanese and English. In the event of any discrepancy or conflict between the Japanese version and the English version, the Japanese version shall prevail.

  • Matters not stipulated in these Terms and any doubts arising from the interpretation of these Terms shall be resolved in good faith through consultation between the Company and the customer to prevent judicial disputes.

  • Any legal dispute arising out of or in connection with these Terms or the use of the Site that cannot be resolved through consultation shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
